City of Greensboro Request for a Permanent Drainage Easement and Temporary Construction Easement at 505 W. Sycamore St.

This item was previously brought to the Board of Education (Board) on May 12, 2009. At that time the Board raised several questions and asked staff to work with the City of Greensboro (City) to provide clarification and to bring this back to a future Board meeting. We have included a letter from the City of Greensboro Water Resources Department dated May 13, 2009 in response to the questions raised by the Board. In addition, staff takes no exception to the final purchase price which was previously increased from the initial offer based on discussions between GCS and City real estate staff.

The following information is what was transmitted to the Board on May 12, 2009:

The District received a letter dated April 3, 2009 from the City of Greensboro (City) offering to pay $47,805 to purchase certain property rights on District property located at 505 W. Sycamore St., subject to approval by the City Council or their designated representative.  We are providing a copy of the letter from the City detailing this request and an appraisal that was conducted by the City to assist them in determining the value of this request.     

We understand that this work is in conjunction with Guilford County’s new jail construction project whereby the City is planning to upgrade a portion of its existing downtown storm water drainage system.

We understand that the City is planning to add a 60” storm drain pipe and is proposing to acquire from the Board of Education (Board) a 30’ permanent drainage easement and a temporary construction easement.  It should be noted that an easement currently divides the property, and this additional easement would partially overlap and generally run parallel to the existing easement.   A sketch showing the location of the proposed permanent easement area and temporary construction easement area is attached for reference.  An exhibit which will be attached to the appropriate Deed of Easement is also attached for reference.

The City has agreed to restore any areas that are disturbed by construction or other activities related to this request at its sole expense. In addition, this property mainly serves as a parking lot for the YMCA under a Shared Use Agreement with the District, and the City has agreed to coordinate this work with the YMCA and the District and to provide any necessary temporary parking for authorized users (the YMCA has been made aware of this request)

The City has informed us that they plan to phase this work in order to ensure that roughly one-half of the width of the overall paved parking area will always be useable for vehicular traffic by YMCA members and other authorized users. The City has also communicated to us that they anticipate the construction period for each phase should not exceed two weeks, and the City also anticipates that construction can commence not later than August 1, 2009 and can be completed by September 1, 2009. 

Should the Board approve this request, the City would require that the Board Chairman sign appropriate offer acceptance documents on behalf of the Board for the City’s records. Legal counsel would also prepare an appropriate Deed of Easement to the City granting the requested permanent storm water drainage easement and the temporary construction easement, as described above. In addition, a Deed of Easement will require execution by the Board’s Chairman. The easement acquisition payment from the City would be deposited in the District’s Capital Outlay Fund.

We are bringing this request from the City forward for consideration by the Board and for any further action that the Board would like for staff to take on this matter. Representatives from the City have also been asked to attend this meeting to respond to any questions.
