NCDOT Three Party Right of Way Encroachment Agreement and Two (2) NCDOT Two Party Right of Way Encroachment Agreements Affecting the Southeast Middle School and Southeast High School Properties

As part of the 2008 Bond, the design work at Southeast Middle School and Southeast High School continues to progress. To accommodate this work, GCS will be required to relocate an existing fire hydrant plus associated appurtenances to a location within the Woody Mill Road right-of-way. In addition, GCS will be required to install approximately 60 linear feet of storm piping within the Woody Mill Road right-of-way and to construct and/or install approximately 1,650 linear feet of pavement widening and associated storm drainage improvements within the Southeast School Road right-of-way.

Since these improvements will be located within state maintained road right-of-way areas, NCDOT is requiring that the Guilford County Board of Education (Board) and the City of Greensboro execute a Three Party Right of Way Encroachment Agreement for the fire hydrant (public water will be available) which will be located within the right-of-way of Woody Mill Road and that the Board execute two (2) separate Right of Way Encroachment Agreements (Two Party Right of Way Encroachment Agreements) for the curb and gutter, pavement widening and storm drainage improvements to be located with the rights-of-way of both Woody Mill Road and Southeast School Road.

GCS legal counsel has reviewed this packet of materials.

RECOMMENDATION: The administration recommends that the Board approve the execution and delivery of a NCDOT Three Party Right of Way Encroachment Agreement and two (2) NCDOT Right of Way Encroachment Agreements (Two Party Right of Way Encroachment Agreements), as described above, affecting both the Southeast Middle School and Southeast High School  properties.
