Shared Use Agreement for Jamestown Youth League at Southwest Elementary School

The Jamestown Youth League is requesting use of the soccer field at the rear of the Southwest Elementary School property. The attachment indicates the location of the field.  The Jamestown Youth League is already a party to a shared use agreement with the Board of Education which provides for joint use of the baseball field at Jamestown Elementary School.  Between July 1, 2005 and June 30, 2010, the Jamestown Youth League was a party to a shared use agreement which allowed it to use the soccer field at Southwest Elementary School in exchange for maintaining the field.  The Jamestown Youth League is currently using the soccer field at Southwest Elementary School under a facility use agreement.

The proposed shared use agreement has been reviewed by Southwest Elementary School administrative staff to ensure that use of the field will not adversely impact GCS activities.  Under the proposed shared use agreement, the Jamestown Youth League will have access to the field beginning at 6 pm on days when school is in session and at all times on days when school is not in session.  The proposed shared use agreement specifically provides, however, that GCS use of the field will always take precedence over use by the Jamestown Youth League.  The agreement will remain in effect for a period of six years unless GCS or the Jamestown Youth League provides 30 days written notice of termination. 

The Jamestown Youth League will maintain the soccer field at its own expense for as long as the shared use agreement remains in effect.  Maintenance will include but will not be limited to mowing, irrigating, fertilizing, aerating and seeding.  The Jamestown Youth League will also pay all utilities costs associated with the use and upkeep of the field.

GCS legal counsel has reviewed this packet of materials.

RECOMMENDATION: The administration recommends that the board authorize its chairman to execute and deliver a shared use agreement (copy attached) to allow the Jamestown Youth League to use and maintain the soccer field at Southwest Elementary School.
