RE:Authorization to Acquire Necessary Turn Lane Right-of-Way Area, Alamance Elementary
In connection with the renovation of Alamance Elementary School, the North Carolina Department of Transportation (NCDOT) is requiring the construction of a turn lane along Southeast School Road to accommodate traffic that will be generated by the school. To accomplish this, GCS is being required to accomplish from three property owners affected by the required turn lane improvements a permanent public right-of-way grant directly from each property owner to the NCDOT. A diagram showing the area of dedicated right-of-way acquisition area for all three parcels is attached for reference.
The total area to be dedicated to the NCDOT is approximately 8,000 square feet.
The administration requests that the board authorize compensation to the three property owners for the necessary permanent right-of-way grants to the NCDOT in the total amount of not more than $5,000. This compensation would generally be based upon the current tax value of the affected property parcels multiplied by the appropriate square footage required.
GCS legal counsel has reviewed this packet of materials.
RECOMMENDATION: The administration recommends that the board authorize compensation to be paid to each of the three property owners affected by the Alamance Elementary School (turn lane) project not to exceed a total of $5,000 and further authorize GCS legal counsel to coordinate the payment of the compensation in exchange for the delivery of executed Secondary Road Right of Way Agreements (or other conveyance documents) as approved by the NCDOT.
